TERMS AND CONDITIONS OF USE AND PRIVACY POLICIES
GENERAL CONDITIONS
1. The use of this Profit Prime digital platform is conditioned to the acceptance and compliance with the Terms and Conditions of Use and Services (“Terms and Conditions of Use”) described below, which are in accordance with the requirements contained in and in other legislation.
2. All rules and conditions applicable to access, use of services, subscriptions, and technologies of this digital platform are set out in these Terms and Conditions of Use and Privacy Policies. Services arising from the commercial activity are offered by Profit Prime.
3. The use of our services is subject to the prior acceptance of these Terms and Conditions of Use. In this way, it is imperative that the User has previously read and agreed with our rules and Privacy Policies. After reading the Terms and Conditions of Use and Privacy Policies, the User expressly confirms that he has understood and accepted all their terms and conditions. Profit Prime advises frequent consultation of the Terms and Conditions of Use and Privacy Policies.
4. The User may only use the Services offered by the Platform by completing a Registration and accepting the rules expressed in these Terms. Thus, by accepting these Terms, the User declares that he has read, understood all his rights and obligations, agrees, and will comply with all provisions herein, automatically binding himself to these Terms and any documentation mentioned in these rules. If you do not comply with the rules, the Registration may be blocked/canceled and the User prevented from using the Platform.
5. May modify/update these Terms at any time, without prior notice to Users.
6. After modifying/updating these, an email will be sent to the User registered on the digital platform and/or by providing a notice on the User's page in their account on the digital platform. The use of the Platform or the Services after the changes/updates to the Terms come into force will again depend on the User's acceptance and agreement to the new contractual terms.
7. The User's silence before the modification/update of these Terms will be considered as acceptance and agreement to the new stipulated terms. If the User does not agree with the changes and/or modifications to the Terms, the User may, at any time, request the cancellation of his/her Account.
8. TO MANIFEST YOUR EXPRESS AGREEMENT WITH THESE TERMS AND CONDITIONS OF USE AND PRIVACY POLICIES, THE USER MUST NECESSARILY CLICK ON THE “I ACCEPT” BUTTON, SHOWING YOUR ACCEPTANCE OF ALL THE RULES PROVIDED FOR USE OF THE DIGITAL PLATFORM, WHICH ARE THE REGULATORY PROVISIONS THE RELATIONSHIP BETWEEN PROFIT PRIME AND THE USER.
9. IF THE USER DOES NOT AGREE TO THESE TERMS, THE USER WILL NOT OBTAIN AUTHORIZATION TO ACCESS THE PLATFORM AND/OR USE THE SERVICES AVAILABLE BY PROFIT PRIME.
PROFIT PRIME PLATFORM
10. Profit Prime owns the “Profit Prime” digital platform, where software focused on operations automation technologies that can be used in the financial market in general, developed and owned by the company, is made available.
11. For the access and use of the software, Profit Prime provides a personalized subscription service that allows our users to freely use the platform, and the rules for using and paying for the subscription are available in the “Terms and Conditions of Use and Privacy Policies – Profit Prime Subscription”, which must be read and accepted when subscribing.
12. Profit Prime does not buy and/or sell cryptocurrencies and digital assets, it only makes available, through its website, a Platform to promote the distribution of automation and access software for use by Users interested in subscribing to the services. Profit Prime is not responsible for the transactions carried out by the Users, as well as for their decisions and for any consequences arising from them, even if they were taken based on the information obtained from the Platform.
13. Profit Prime is not a financial institution, payment arrangement maker, or securities and/or cryptocurrency broker.
14. Cryptocurrencies and digital assets used on this Platform are not securities regulated by the federal trade commission (FDC), nor securities issued or endorsed by any government, central authority, or monetary authority.
15. The Platform is intended for the User's internal and personal use, and its use for commercial purposes is not authorized.
REGISTER
16. The access and use of the Platform are directed only (i) to natural persons over 18 (eighteen) years old, national or foreign, who have the full legal capacity to use it and (ii) to companies in good standing, legally constituted existing in accordance with foreign legislation. In the case of an emancipated natural person under the age of 18 (eighteen) years, it is necessary to send the document proving emancipation.
17. In order to use the Platform, the User, an individual or legal entity, must register in the system, informing the following data:
- Country;
- Full name;
- Valid email;
- Cell phone;
- Birth date
18. After Registration, the User will be the holder of a User Account, which can only be accessed by using the login and password created by the user at the time of Registration. The login created cannot bear any resemblance to the “Profit Prime” brand and, if deemed, at Profit Prime's sole discretion, offensive or obscene, the User Account may be blocked or canceled. The User is responsible for his account and for any activity associated with it.
LOGIN AND PASSWORD DATA
19. The User will use his e-mail address informed as “Login” and his own password chosen at the time of registration to access the Platform.
20. The User understands that the login and password created are personal and non-transferable, being the sole and exclusive responsibility for maintaining such data in security and secrecy, thus avoiding the unauthorized use of their Registration by third parties.
21. Users are prohibited from sharing their login and password with third parties.
22. Entering the login and password binds the User to any and all activities carried out on the Platform with their Registration, with the User being solely responsible for the activities carried out on the Platform, as well as access to any and all personal information registered in their personal area on the Platform.
23. In case of forgetfulness, loss, or theft of their login details and/or access password, the User must immediately notify Profit Prime via the electronic email address [email protected], as well as any risk of access by unauthorized third parties to the Platform through your Registration.
24. If the User's login data and/or password have been lost or stolen, the User will remain responsible for the information on their behalf on the Platform through their Registration, and must immediately communicate the fact to Profit Prime, through the [email protected] email address.
25. Once the User's email notification about the loss or theft of his/her login data and/or password is received, Profit Prime will immediately block the User on the Platform, subsequently performing the recovery of his/her Registration or, as the case may be, carrying out a new Registration.
26. The User may, at any time, terminate and inactivate his Account on the Platform through his profile. The inactive Account may be recovered at any time by the User. The information contained in the Account, after its inactivation or termination, will remain on the Platform's systems and available to Profit Prime. If the user wishes to have their personal data deleted, they may notify Profit Prime to do so, as provided for in the relevant legislation.
27. Profit Prime reserves its right to block the User's Account if it finds evidence that third party fraudsters and/or hackers are trying to access the User's Account improperly, in which case it will be immediately communicated to the User by the registered email or telephone.
28. Profit Prime reserves the right to block the User's Account if it finds evidence that the User is using the Platform illegally or against the provisions of the Anti-Money Laundering and Abusive Practices of Offers and Terrorist Financing Policy. , as well as other legislation, in which case it will be immediately communicated to the User by the registered email or telephone.
29. As this is a security measure to avoid property damage to the User, any damages incurred by the User cannot be transmitted to Profit Prime, and it is not responsible for any compensation for damages resulting from the inability to access the Account by the User.
30. It is the User's responsibility to:
(i). keep the environment of their access devices to the website and Platform safe, using specific tools for that, such as antivirus, and firewall, among others, in order to contribute to the prevention of electronic risks;
(ii). use up-to-date and efficient operating systems for full use of the Platform;
(iii). equip and be responsible for the hardware devices necessary to access the Platform, as well as their access to the Internet.
PRIVACY POLICIES
31. The Profit Prime website and platform are in full and direct compliance with national and international legislation dealing with the treatment and processing of personal data, respecting the principles contained in Act 2018 is the UK's implementation of the General Data Protection Regulation (GDPR ), which are: the purpose; adequacy; necessity; free access; data quality; transparency; safety; prevention; non-discrimination; and accountability.
32. Users are guaranteed, as determined, the following rights: confirmation of the existence of treatment; data access; correction of incomplete, inaccurate, or outdated data; anonymization, blocking, or elimination of unnecessary, excessive, or treated data in violation of the provisions of national legislation; data portability to another service or product provider, upon express request and observing commercial and industrial secrets, in accordance with the regulation of the controlling body; elimination of personal data processed with the consent of the holder, except in cases of compliance with a legal or regulatory obligation, a study by a research body, and other reservations provided for in the specific rule; information from public and private entities with which the controller made shared use of data; information about the possibility of not providing consent and the consequences of denial; revocation of consent.
33. The ProfitPrime website and platform will not collect sensitive data from its Users.
34. User understands and expressly agrees that the data provided may be shared with third parties by the company hired, in order to use and process the information, namely, the payment method used to subscribe to the plans. For the purpose of acknowledging the payment and recognizing the User by the Profit Prime platform and by the payment intermediary, User data must be shared between companies, within the limits necessary for the proper identifications.
35. Data collection carried out on third-party platforms, outside the Profit Prime platform, must follow the rules and compliance of that company.

USE OF THE PLATFORM AND OPERATIONAL LIMITS
37. In order to use the Services made available on the Platform, it is necessary for the User to register, which will authorize the use of the Platform, as well as access to the subscription panel and information on the use of the software made available by Profit Prime.
38. The User declares that the personal information provided at the time of registration is correct, complete, and true and undertakes to keep his data always updated. Otherwise, the registration may be blocked and the User is prevented from using the platform.
39. The Profit Prime platform uses the Prime Dollar (PUSD) cryptocurrency as the basis of operation and transaction, which is the digital representation backed by the US dollar.
40. To use the services available on the Profit Prime platform, the User must acquire the PUSD cryptocurrency at any cryptocurrency exchange, or through P2P transactions, that have the cryptocurrency listed and support the transactions.
41. Both at the beginning of the use of the services, and at the end and withdrawal of the platform, the PUSD cryptocurrency will be used, and the platform is not compatible with any other crypto asset.
42. In order to carry out transactions within the Platform, the User will receive a Virtual Wallet, which is automatically created after completing his/her Registration on the Site and Platform. This “Virtual Wallet” is equivalent to the representation of cryptocurrencies and digital assets owned by the User, not being equivalent to a checking account at a financial institution.
43. Profit Prime is not responsible for errors made by Users regarding the information and data of their Virtual Wallet and recommends that all transactions be carried out with prudence, wisdom, and a minimum level of knowledge about cryptocurrency transactions and digital assets, their operation, valuation, and oscillation.
DEPOSITS AND WITHDRAWAL TERMS
44. The User may use their wallet within the Profit Prime Platform to transfer their PUSD cryptocurrencies from their broker to the platform, as well as to withdraw their cryptocurrencies from the platform to their brokerage firm.
45. The period for receiving cryptocurrencies on the platform and withdrawing from the platform will follow the time of transactions on the network in which the PUSD cryptocurrency uses, that is, after the transfer request to the Profit Prime platform, the User will receive the cryptocurrencies in your wallet within the platform only after processing the order on the network, and the withdrawal process will follow the same pattern.
46. Profit Prime is not responsible for deadlines and information received on other platforms.
47. Upon withdrawal of crypto assets from the Profit Prime platform, a fee is charged on the withdrawal amount, as well as a fixed fee of 1 PUSD.
REFUSAL OF REGISTRATION AND CANCELLATION OF THE USER'S ACCOUNT
48. Profit Prime reserves the right to refuse the registration request of a possible User in the event of a violation of any provisions set forth in these Terms, the legislation and legal rules applicable to the activity performed by it, as well as the impossibility of verifying the identity of the possible User or verification of falsehood in any of the information provided by him.
49. Profit Prime may suspend and/or cancel the User's access to the Platform in cases of
(i). violation of any of the provisions of these Terms and Conditions of Use and the relevant and applicable laws and regulations;
(ii). impossibility of verifying the User's identity or verification of falsehood in any of the information provided by the User;
(iii). practice by the User of fraudulent, intentional or incompatible acts with the purpose and object of the Platform, which may harm other Users and may cause damage to third parties or to the Platform itself.
50. If Profit Prime detects any Registration made from false, incomplete, erroneous, misleading information or by irregular or non-existent companies, or still, it cannot detect the User's identity, this registration will be automatically blocked until the situation is regularized, or excluded if there is no regularization. If excluded, the User's access to the Platform and Services will be definitively canceled, as well as these Terms will automatically terminate.
FINAL DISPOSITIONS
51. These Terms and Conditions of Use are governed by international laws and regulations. Any questions and situations not provided for in these Terms of Use will be preliminarily resolved by Profit Prime.
